The Constitutional Court concluded on Tuesday a series of hearings involving 602 disputes arising from the national, provincial and district elections held on April 9, opening the way for the General Elections Commission to declare a revised list of elected candidates across the country.
The final verdicts delivered by the court — ending work it began a month ago — were those in cases filed by the Democratic Party, the Golkar Party, the National Mandate Party (PAN) and the Prosperous Justice Party (PKS).
The court ruled that there were miscalculations in two regencies, Humbang Hasundutan, North Sumatra, and Bengkayan, South Kalimantan.
The PKS, according to the verdict, deserved to get 1,221 votes in Humbang Hasundutan and 1,645 votes in Bengkayan. The ruling likely means that the PKS would receive at least one extra seat in the respective regency councils.
In cases involving PAN, the court approved the party’s claims in 13 electoral regions but rejected 31 others. The court ruled that PAN won in Bengkulu, South Sulawesi, West Sumatra, North Sumatra and South Sulawesi as well as some electoral districts in the regencies of Mamuju, West Sulawesi; Ogan Komering and Mamasa in South Sulawesi; Purbalingga, Central Java; Kampar, Riau Islands; Banjar, South Kalimantan; Kerinci, Jambi; and Kapuas, East Kalimantan.
PAN representative Herman Kadir said the party was likely to get one seat in each of the five provinces and one seat in each of the eight regencies.
“Not a bad outcome,” he said.
KPU member Andi Nurpati said the commission would not declare the revised list of the elected legislators, councillors and members of the Regional Representatives Council (DPD) as it was still concentrating on the presidential elections.
“The presidential polls will be held in two more weeks while the inauguration of the elected House of Representatives and DPD legislators will not take place until October. So we still have some time,” she said.
Another KPU member, I Gustri Putu Artha, said that the commission also needed to study the verdicts in all the cases decided by the Constitutional Court. “We may write to the court to clarify some things,” he said, adding that the commission would give priority to the elected councillors, or DPRD members, as their inauguration would take place in either July or August.
The Constitutional Court rulings will change the seat composition of the House, the DPD and DPRD (provincial and regency councils), since it has annulled the original KPU decree on the final allocation of seats made following the April 9 legislative polls.
According to the Center for Electoral Reform, the court decision is likely to change the fate of 16 prospective House legislators, including House Speaker Agung Laksono from the Golkar Party.
