AGO Demotes, Relocates Prosecutor at Center of E. Java Prisoner-Swap Fiasco

The Attorney General’s Office announced on Thursday it would punish the East Java prosecutor at the center of a prisoner swap scandal by transferring him to a desk job in Jakarta.

Wahyudi, chief prosecutor in Bojonegoro, has been widely criticized for lax oversight after it was revealed that a female convict there, Kasiem, had paid another woman Rp 10 million ($1,110) to serve a seven-month sentence in her stead.

Marwan Effendy, deputy attorney general for internal supervision, said Wahyudi would soon be “recalled” to the AGO and placed in a low-ranking position, “not a managerial one.” He said the new post would later be confirmed by the attorney general.

AGO spokesman Babul Khoir Harahap confirmed the demotion and said it would take effect on Monday.

He added Wahyudi had already received a written reprimand over the matter and could be fired if a probe showed there was cause. “Before an official is removed, there must be some sort of disciplinary sanction that comes as a result of an investigation,” he said.

“We can’t remove an official without first handing out this sanction.”

Separately, the East Java prosecutors’ office had issued written warnings to Wahyudi and Hendro Sasmito, chief prosecutor for special crimes in Bojonegoro, and temporarily suspended Tri Murwani, the prosecutor who tried Kasiem’s case.

The office also fired Widodo Priyono, the staffer who was supposed to have escorted Kasiem to prison.

Muljono, an official with the provincial prosecutors’ office, brushed off criticisms that the punishments were light.

“These letters of reprimand are pretty serious,” he said.

“They’re going to be a black mark against these officials for as long as they try to make a career in the prosecutors’ office.”

The details of the prisoner switch are the subject of a war of words between the AGO and Ministry of Justice and Human Rights, which is in charge of the country’s prison system.

The AGO claims that a guard at the prison, identified as Atmari, offered the switch to Kasiem’s lawyer, Hasnomo.

However, Justice Minister Patrialis Akbar claims the switch occurred while Kasiem was being transported to the prison by prosecutors.

Meanwhile, Kasiem has since been jailed, while Hasnomo and two of his assistants have been named criminal suspects.
