The Jakarta Anti-Corruption Court sentenced businesswoman Dharnawati on Monday to two and a half years in prison for providing Rp 2 billion ($224,000) in bribes to two officials at the Ministry of Transmigration.
The court, presided over by Judge Eka Budhi Prijanta, ruled that the money was given in return for appointing Dharnawati’s company, Alam Jaya Papua, to projects in four Papuan districts under the ministry’s Fund for the Acceleration of Infrastructure Development in Transmigration Areas (DPPIDT).
“The defendant [Dharnawati] committed acts that hurt people’s sense of justice,” Eka said in the verdict read to the court.
The court said two other defendants in the case, ministry officials Dadong Irbarelawan and I Nyoman Suisnaya, had sought a 10 percent kickback from the Rp 73 billion in total committed to the projects.
But Dharnawati said that she was only able to provide Rp 2 billion. One quarter of that amount, the court found, was transferred to Nyoman’s account while the remainder was given in cash.
Dharnawati and the two ministry officials were caught red-handed by the Corruption Eradication Commission (KPK) last August.
After the verdict was handed down, Dharnawati declined to comment, sobbing as she was escorted from the courtroom. As she was exiting, she bumped into the courtroom door.
Her grief continued well into the afternoon when she was scheduled to testify at Dadong’s trial. “I am sorry. I am not prepared [to testify],” she told the panel of judges at Dadong’s trial as tears rolled from her eyes.
The presiding judge at Dadong’s trial, Herdi Agusten, told the prosecution to postpone Dharnawati’s testimony until Feb. 6.
Prosecutors earlier alleged that Transmigration Minister Muhaimin Iskandar played a role in the bribery scandal, but Dharnawati’s lawyer, Djaka Sutrasta, said Muhaimin’s name was being used by his subordinates to distance themselves from the case.
“Muhaimin’s role [in the case] was never revealed in court,” the lawyer said.
Dharnawati earlier said she had given the KPK the names of several people who had demanded payment in return for help winning ministry contracts.
Two of them, Ali Mudhori and Mohammad Fauzi, are members of Muhaimin’s staff. Another, Sindhu Malik, is a retired Finance Ministry official. None of the three have been named a suspect.
During Dharnawati’s trial, Dadong said Sindhu acted as a broker, determining what projects Dharnawati should be awarded and how large the kickbacks should be. Sindhu, Dadong said, claimed to be a consultant for the House of Representatives Budget Committee.
