Definition of adultery:

"Voluntary sexual activity (as sexual intercourse) between a married man with someone other than his wife or between a married woman and someone other than her husband"

I would perceive this issue as fornication as there was consensual sex between two "single" persons. The onus of proof now lies with the poor guy who I trust has learnt his lesson from "one night" stands.

This issue would have also happened without the "help" of facebook! The woman wanted to cheat and actually it was her who did not tell the truth and not the "poor" fellow, now charged with adultery.


A Facebook user from Surabaya was arrested by police after he went on a date with married woman whom he met on Facebook. He was detained after the woman’s husband reported him for adultery.

Anjasmara (not his real name) was arrested by East Java’s Gresik Police, Kompas.com reported. Anjas was arrested after taking a woman named Via, 23, (not her real name) on a date, the wife of Bakri, 35.

According to Anjas, Via was the one who added him as a Facebook friend. In her Facebook personal information, Via wrote she was “a single woman who yearns for love.” The two had intensive communication on Facebook until they finally agreed to meet in real life, the newspaper reported.

On Friday, Bakri saw Via riding a motorbike with an unfamiliar man in downtown Gresik. Bakri said he tried to stop the motorbike, but it sped off.

Anjas later told police he wanted to stop when waved down because he was curious, but Via told him to keep going because she did not know who the man was. The two went to Surabaya and spent a night together. The next day, Via told Anjas the truth about her marriage. He felt obligated to return her to her husband and asked Via to arrange a meeting with him the next day.

On Sunday, Anjas and Via arrived in Gresik and were welcome by Bakri as well as two officers from Gresik Police. Anjas apologized to Bakri but he said that Via also shared the blame for posing as a single woman online.

Gresik Police Chief Adj. Comr. Sri Andriyani told Kompas.com that the Facebook lovers admitted they had sex in Surabaya. They will be charged under Chapter 284 of the Criminal Code for adultery and could face a jail term.
