This is the result of a codified legal system. Set punishments for set crimes. The set punishment for corruption is low so that they can beat the 5 year conviction criteria to give all convicted felons the ability to rejoin the government and do it all over again.

The codes will state the minimum for drugs. The minimum for stealing a telephone card, the minimum for blowing up innocent people. The judges have the choice to go above or within the limits set by the codes and asked for by the prosecutors. The people who set the codes and levels of punishment ... well who knows what they are thinking.

One thing thought the courts in Bali are consistent on this subject if nothing else. At least we don't see people getting off with time servered and Rps 1000 fine. No police crying in the court when the defendant waxes lyrical and starts to cry. Nope, 18 years, bugger what the prosecutor says....

If only they would enforce the same penalties for the politicians stealing rice out of the mouths of the poor. That is more of a crime than these guys.

I will never truly understand the Indonesian legal system - terrorists are walking off with lenient sentences plus are walking off quite easy with sympathizing judges on their behalf while drug smugglers are getting heaviest sentences imaginable. UI agree though that drug smugglers should be punished, I just cannot understand the huge differences. BTW, what happened with this two politicians who had been caught in the act a while ago in Bali? Are they still well?

Denpasar. An Indonesian court Thursday jailed a Japanese man for 18 years for smuggling hashish into the resort island of Bali.

Morita Yuki, 35, was arrested in November last year after landing in Bali from Bangkok with 5.9 kilograms of hashish, which police valued at $410,000, hidden in the lining of his suitcase.

“The defendant has given an opportunity for illegal drugs to be distributed in Indonesia and that’s against the government’s efforts to eradicate drug use,” presiding Judge Agus Subekti told the Denpasar District Court.

The sentence was three years higher than the prosecutors’ recommendation.

Defence lawyer Stefanus Tobas described the sentence as “too heavy” and said he would appeal.

The Denpasar court on Monday jailed an Australian for 18 years for smuggling less than two kilograms of methamphetamine into the island.

Indonesia enforces stiff penalties, including death, for drug trafficking.
