Though the Jakarta High Court on Friday upheld the 3.5 year jail sentence passed against infamous Indonesian police officer Comr. Gen. Susno Duadji, the former National Police chief of detectives remains a free man for “reasons of humanity.”

Susno, convicted of embezzlement and taking bribes in two separate cases in March this year, was not jailed pending his appeals, a vagary of the Indonesian justice system that is often applied to the wealthy or connected.

Susno, once one of Indonesia’s most disliked individuals before attempting to redeem himself by blowing the whistle on a number of allegedly corrupt senior officers — none of whom have ever been charged — did spend 120 days in detention prior to his eventual trial.

Speaking on Friday, Jakarta High Court spokesman Achmad Sobari said the court upheld the sentence and fine of Rp 200 million, but “with the reason of humanity, the judges did not order that he be detained.”

He did not elaborate, though Susno is expected to appeal to the Supreme Court.

The court did order that Susno forfeit an addition Rp 4.2 billion ($466,000) or face an additional four months in jail.

Attorney General Basrief Arief said he would wait for a copy of the verdict before deciding whether to appeal.

The prosecution had been seeking a seven-year jail term.
