I wonder why these universities are refusing to name the brands of baby formula to be revealed? And even going so far to basically ignore a ruling by the Supreme court! Wouldn't it be for the consumer from utmost importance to have the names of the producers revealed? Now they are counter-suing and don't even show up at court...looks just as there are certain, very specific corporate "sponsors" for these named universities...so who cares if babies are getting sick or die as long the wallet is full!

The opening of the trial of five universities countersuing lawyer David Tobing after the Supreme Court ruled that they reveal the names tainted infant formula brands was delayed on Wednesday because related parties failed to show at court.

Representatives from the Bogor Institute of Agriculture (IPB) and the Food and Drug Monitoring Agency (BPOM) failed to show at Central Jakarta District Court on Wednesday, while a representative from the Health Ministry turned up late.

In its verdict issued in April 2010, the Supreme Court ruled in favor of David and ordered the Health Ministry, the Food and Drug Monitoring Agency (BPOM) and the IPB to name the brands of tainted formula that it had discovered through research. The three bodies refused, stating the study was only intended as educational research.

The five universities filed an appeal, requesting a review of the Supreme Court's ruling.

David, who did appear in court on Wednesday, said that the universities were stalling.

"First of all, the trial should not be separated like this, those five universities could be in one case, consider to the material is same" David said.

The five universities countersuing David are University of Indonesia, Padjajaran University, Hasanuddin University, North Sumatra University and Andalas University. The trial on Wednesday was to be the first rebuttal session   by North Sumatra University [USU] and Andalas University.

"Secondly, this kind of countersuing is highly reflecting that both of them, conspiracy, are trying to stall the execution of Central Jakarta District Court's decision, which was strengthened by Supreme Court" said David.
