The Supreme Court needs to set a firm limit on the amount of time death row inmates have to initiate a judicial review of a conviction because it is frequently used to delay executions, the attorney general said on Friday.
“There should have been several executions [last year] but they were delayed. Not because of the prosecutor’s problems, but issues outside our office,” Hendarman Supandji told a news conference. “If the case is final, the execution should not be delayed. There must be a specific limit.”
The AGO last year proposed that the Supreme Court issue a ruling to limit the period to prevent inmates from buying time, but the court said that prosecutors should decide.
The court recommended that the application window be restricted to 180 days.
According to the AGO, there are 107 inmates on death row, including 51 drug traffickers and two convicted militants.
Some 43 of the 107 have yet to confirm whether they will be seeking a judicial review of their convictions or if they will apply for the second extraordinary option — a presidential pardon.
After the Supreme Court rejects an appeal, death row inmates have only those two options.
An application for a judicial review by the Supreme Court requires that the inmate provide new evidence in support of his or her innocence.
Asking for a presidential pardon must be preceded by an admission of guilt to the crime.
The AGO said that six inmates had been declared ready to face the firing squad.
They are drug trafficker Meirika Franola and murderers Gunawan Santosa, Bahar bin Matsar, Jurit bin Abdullah, Ibrahim bin Ujang and Suryadi Swabhuana.
