The Prosperous Justice Party on Thursday vowed not to interfere in the legal process against one of its lawmakers suspected of having issued a fictitious letter of credit to access bailout funds injected into PT Bank Century.
Anis Matta, the secretary general of the Prosperous Justice Party (PKS), said the party would take a “wait-and-see” approach while closely monitoring the legal process.
“It’s not about whether we protect our members or not, but we are following regulations,” Anis said.
PKS lawmaker Mukhamad Misbakhun, who helped initiate the legislative probe that found the Bank Century bailout illegal, is being investigated by the police over the alleged fictitious letter of credit.
Bank Mutiara, formerly Bank Century, has already said that Misbakhun is innocent.
“For the time being, let’s just wait and see. This case is just being used [by the government] to press the PKS,” Anis said.
However, he was quick to add that the PKS would never attempt to shield party members from legal proceedings when it came to alleged breaches of the law.
Former PKS chairman and the current communication and information minister, Tifatul Sembiring, also said the party would never impede a legal investigation. He said the PKS would not protect any member who violated the law.
“Please [put him through the legal process], no one is immune before the law,” Tifatul said. “The PKS will never protect those who violate the law. It was not under the PKS name, it’s his personal business.”
The National Police have named former Bank Century owner Robert Tantular, who is serving a five-year prison sentence for bank fraud, and Linda Wangsa Dinata, who chaired the bank’s branch in Senayan, South Jakarta, as suspects in the case.
Officers leading the investigation said the case was considered a general crime instead of a banking crime, as alleged by Andi Arief, the presidential aide who reported the case to the police.
Police opened the investigation earlier this month — at the behest of the president — to look into the allegations that the PKS legislator owed Bank Century nearly $20 million.
The bank, however, said it did not consider the letter of credit from PT Selalang Prima Internasional, which is majority owned by Misbakhun, fictitious. It said it considered the letter of credit as a non-performing loan as the company had returned $6 million and had agreed to pay the remainder in installments.
Misbakhun has said the company’s letter of credit had no link to the bailout funds and accused Andi of attempting to distract attention from the Century bailout investigation. The presidential aide filed the police report just a week before the House special committee investigating the bailout issued its final recommendation.
